By booking, purchasing, or otherwise agreeing to participate in dog training, dog boarding, dog walking, or other services provided by Pintar Dog Training and Stella Vasileva you agree to Dog Training Terms and all the information below.
Overview
Pintar Dog Training, including but not limited to Stella Vasileva and other representatives, (hereinafter referred to as “Pintar Dog Training”) – service provider.
Dog owner (hereinafter referred to as “Dog Parent” or “Participant”) – any person agreeing to book, purchase, or otherwise participate in dog training, dog boarding, dog walking, or other services provided by Pintar Dog Training.
Services.
Pintar Dog Training agrees to provide dog related services including but not limited to: private dog training lessons, private coaching, training during walks, private and group walks, pet sitting and boarding.
Private training sessions (including but not limited to private lessons, private coaching, training walks). Pintar Dog Training agrees to provide private sessions to Dog Parents and their dogs on a session-by-session basis, the goal being to teach Dog Parent how to train and work with dogs. These sessions will take place at Dog Parent’s home and outside the house, as well as in other location agreed with the Pet Parent. Pintar Dog Training will make every reasonable effort to help Dog Parent achieve training and behavior modification goals but makes no guarantee of dog’s performance or behavior as a result of providing professional animal behavior consultation. Dog Parent understands that he/she and members of the household must follow Pintar Dog Training instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to dog.
Understanding of responsibility and risks
Pet Parent states and affirms that Pet Parent has provided to Pintar Dog Training with complete and accurate information about Pet Parent’s dog, including its habits, health, behavior, training, temperament, and any other matters that may impact Pet Parent’s suitability for services and/or risk of injury to the dog, other dogs, and people.
Pet Parent agrees not to use any aversive tools during, between training sessions and 12 months after the last training session (aversive tools included but are not limited to: prong collars; choke chains or slip leads; electric, shock, vibration collars; or any other tools means to correct or punish animals). Pet Parent agrees to withdraw any physical punishment, mental intimidation, and voice corrections during, between training sessions, and 12 months after the last training session. Pet Parent understands that using training tools outside of positive reinforcement can and will interfere with the training process and will lead to poor outcomes for their dog.
Dog parent participating in training, walking, boarding, daycare, or attending consultations acknowledges that they are voluntarily participating in services provided by Pintar Dog Training with knowledge of the potential dangers. Participant acknowledges that dogs are unpredictable animals with their own will and drives, and therefore, regardless of training, handling, or environmental circumstance, Pintar Dog Training cannot protect against every potential injury, risk, or accident to you, to other persons participating in the training or on the property where the service is taking place, or to dogs. These may include dog attacks, dog bites, and the responsive actions and complications that arise from them, and you understand and acknowledge that such risks are inherent and cannot be eliminated. This Terms of Service is intended to shift the risk of participating in dog training and other services to dog owners. Do not sign this waiver unless you are willing to assume the risk to yourself, your dog, and others accompanying you of your participation in dog training or other services, including the associated risks of bodily injury, death, or property damage while participating in the dog training and related activities on the property of Pintar Dog Training, in your own home, or in a public space.
No guarantee of results
The training services Dog Parents receive are intended to give knowledge and guidance on how to train their dog, as well as homework to perform between sessions. Dog Parents recognize that the role they play in their dog’s learning process is integral to achieving desired results. Dog Parents understand that dog’s progress will depend solely on the amount of time and effort to exercise, train, and work with the dog on a daily basis.
Pet Parents acknowledge and agree that there is no guarantee that the dog will achieve the desired level of training, despite the best efforts of Pintar Dog Training. Pet Parents further understand that the recommendation of any other product or service by Pintar Dog Training is not a guarantee of satisfaction with that product or service.
Dog’s health
Pet parent is fully responsible for the dog’s health and agrees to do a vet checkup if recommended by Pintar Dog Training. All the health relations topics discussed during sessions with any representative of Pintar Dog Training should be considered general information and not used as any health advice. Pet parent is responsible to consult with a vet professional before making any changes in their dog’s routine.
To participate in any services provided by Pintar Dog Training all dogs are required to have age-appropriate vaccinations such as Parvovirus, Distemper, Infectious Hepatitis (Adenovirus) and Rabies.
Media release
Pintar Dog Training believes that electronic documentation is an incredibly useful training tool, and Pet Parent understands and agrees that sessions may be videotaped or photographed during lessons or consultations to enhance Pet’s Parent training skills.
Pintar Dog Training representatives and employees have the right to take photos or videos of participating pets and pet owners, and any other persons present during dog training or during any service conducted by Pintar Dog Training. Dog Parents acknowledge the right of Pintar Dog Training to copyright, use, and publish any media created based on the photo and video taken, on the internet, in print, TV, or any other media outlets. Dog Parents agree that Pintar Dog Training may use such photos and videos of them and/or their pets with or without their name and without prior permission and for any lawful purpose, including, for example, such purposes as publicity, illustration, advertising, social media, education materials, online courses or web content. You waive any right to inspect or approve any photo, video, or audio recordings taken by Pintar Dog Training.
Training fees
Dog Parent agrees to pay Pintar Dog Training fee for every session or a package of sessions before the begin of services. Pet Parent understands that all training and other services are good for one year from the commencement of services, and any services not used within the one-year period will be forfeited and cannot be transferred to other people or dogs, or used for other services.
Dog parent acknowledges that services that are offered on weekly or monthly basis have an expiration date and failing to attend or utilize all the sessions will result in the unused sessions to be forfeited.
Dog parents acknowledge that most training plans will require between 6 and 15 training sessions and agree to commit to at least 4 follow-up sessions if willing to train with Pintar Dog Training.
Cancellations, rescheduling and refunds
If Dog Parent fails to give at least 48 hours of cancellation or reschedule notice, is not present, or is unable to participate at the time of the scheduled appointment, a cancellation fee will be charged. For a weekly or monthly program, or a package deal, the session will still be counted as one session.
Please be aware that there are no refunds for on-demand/self-study courses, on-demand lessons, or webinars.
All services provided by Pintar Dog Training are non-transferable and most services are non-refundable, for more details refer to Refunds and cancellation policy.
By participating in any services by Pintar Dog Training, Dog Parents are agreeing to the cancellation fee charge and refunds and cancellation policies and are giving Pintar Dog Training permission to charge the credit card or agree to pay this cancellation fee prior to the next visit.
Termination
Pintar Dog Training reserves the right to terminate the training contract at any time before or during its term if it determines that a danger exists to the health and safety of the public, trainers, dog owners, or dogs or if Pet Parent has breached the Terms of Service. The use of or being under the influence of illegal drugs and/or alcohol before or during any class or private lessons will result in a canceled contract with no refunds.
In the case of Termination, all fees are non-refundable and non-transferable.
Release of liability
Dog Parent agrees that in consideration for being permitted to participate in any services provided by Pintar Dog Training, dog owner, for himself/herself/themself, and his/her/their heirs, next of kin, executors, and personal representatives (collectively, “Releasors”), assumes the entire risk associated with participating such an activity and waives, releases, discharges and covenants not to sue Pintar Dog Training, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns (collectively, “Releasees”), from any and all liability to Releasors for any loss, harm, damage, claim, injury (including death) or accident to the person or property of Dog Parent, Dog Parents dog, and any other persons accompanying Dog Parent at the dog training, including any minor children, arising out of or related to participating in dog training or using any facilities or equipment of Pintar Dog Training, even if caused by any negligent act or omission of Releasees. Nothing herein is intended to release Releasees from any harm, injury, claim, or damage caused by intentional, wanton, or reckless misconduct.
Indemnification
You agree that you are and will be responsible for your conduct and the conduct of your dog and others accompanying you (including minor children) at all times. You agree to indemnify and hold harmless Pintar Dog Training, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers, and other representatives (“Pintar Dog Training Personnel”), from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, dogs, or property caused by the acts or omissions of you, your dog, and any other persons accompanying you, including any minor children, during the course of training or related activities, as well as by the conduct of your dog under your own care as a result of following training instructions. This provision applies whether the claims are made by you, members of your family, your accompanying guests, Pintar Dog Training Personnel, or third parties.
Liability
If Pet Parent’s Dog causes property damage, or bites or injures any dog, animal, or person (including but
not limited to Pintar Dog Training Personnel), during the participation in the services, Dog Parent agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Pintar Dog Training Personnel and it’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses,
including attorney fees.
Savings Clause
You expressly agree that the foregoing assumption of risk, release, waiver, and indemnity provisions are intended to be as broad and inclusive as permitted by applicable law and that if any portion thereof is held invalid, you agree that the remaining provisions will continue in full force and effect.
Knowing and voluntary execution
By enrolling or participating in Pintar Dog Training, you declare that you are at least 18 years of age and competent to sign these Terms of Service. You acknowledge that you have carefully read this Terms of Service, understand its contents, and agree to be bound by its terms. You specifically understand that this Terms of Service includes an assumption of the risk of Pintar Dog Training’s negligence and a release of Pintar Dog Training’s liability.
Change of Terms
Pintar Dog Training is permitted to revise these Terms at any time as it sees fit, and by using Pintar Dog Training website (https://pintardogtraining.com/ and https://pintar.dog) you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use Pintar Dog Training services.
